RESUMEN: ABSTRACT:

El patrimonio familiar es aquel que está conformado por una cantidad limitada de bienes para el sostenimiento y la estabilidad de la familia. A pesar que cuando hablamos de patrimonio se hace referencia a la riqueza familiar, este va mucho más allá del ámbito financiero, ya que podemos mencionar un patrimonio intangible e incluir características de ámbito social o intelectual herencia hacia los miembros del núcleo familiar como sus valores y principios, las relaciones familiares, sus costumbres y tradiciones que, así como los bienes económicos también se enfocan a promover el bienestar familiar. A continuación, se presentan generalidades del patrimonio familiar que hacen referencia a sus elementos, características, lo que es necesario para su establecimiento y bajo qué circunstancias podría terminar. The family wealth is the one that is formed by a limited amount of goods for the sustainer and the stability of the family. Although when we talk about heritage we refer to family wealth, it goes far beyond the financial sphere, since we can mention an intangible heritage and include characteristics of social or intellectual heritage towards the members of the family nucleus such as their values and principles, family relations, their customs and traditions that, as well as economic assets also focus on promoting family welfare. The following is an overview of the family’s heritage, which refers to its elements, characteristics, what is necessary for its establishment and under what circ*mstances it could end.

Definición del patrimonio familiar: Definition of family wealth

El patrimonio es una institución en la cual se determina un conjunto de las propiedades de la familia, sus derechos y las obligaciones que poseen. Su finalidad es brindar seguridad y así garantizar la protección del hogar. Para esto se debe estipular un determinado tiempo para que se pueda disfrutar de estos bienes. Fundamento Jurídico Legal Foundation

El tema de patrimonio familiar se encuentra enmarcado dentro de la legislación guatemalteca en el Código Civil Decreto 106 del Libro I y Título II en el capítulo X y se regulan desde el artículo 352 hasta el artículo 368.

A continuación, se resume lo que constituye cada artículo: ➔ Art. 352 Se define al patrimonio familiar ➔ Art. 353 Se explica acerca de los bienes que pueden ser constituidos. ➔ Art. 354 Se explica cuántos patrimonios pueden establecerse por cada familia. ➔ Art. 355 Se estipula el valor de los bienes. ➔ Art. 356 Nos dice que los bienes no se pueden dividir con nadie más ➔ Art. 357 Está prohibido cualquier tipo de fraude. ➔ Art. 358 Comenta acerca de las obligaciones que tienen los miembros de familia hacia el patrimonio familiar. ➔ Art. 359 Constituye las condiciones que The issue of family wealth is covered by

Guatemalan legislation in Civil Code, Decree 106 of Book I and Title II in Chapter X and is regulated from Article 352 to Article 368.

Para su constitución

De acuerdo con el artículo cuatro del código procesal civil y mercantil se necesita: ● Nombre, apellidos, edad, estado civil, domicilio, nacionalidad ● Situation, valor, dimensiones, linderos ● Tiempo que dura el patrimonio familiar ● Valor de los bienes

For its constitution

In accordance with article four of the civil and mercantile procedural code, the following is required: ● Name, surname, age, marital status, domicile, nationality, location, value, size, dimensions, boundaries, etc. ● Location, value, dimensions, boundaries ● Duration of the family estate ● Value of the assets

Montos para el establecimiento del patrimonio familiar Amounts for the establishment of family wealth

El artículo 355 indica que para poder establecer un patrimonio familiar la cantidad máxima debe ser de cien mil quetzales cuando se realice su constitución. La cantidad inicial del patrimonio puede ser menor al valor mencionado hasta poder ampliarse al valor máximo conforme al procedimiento de su constitución.

El valor también puede ser disminuido cuando por causas posteriores a su establecimiento, se ha sobrepasado la cantidad fijada como máxima, o debido a que sea de utilidad y de necesidad para la familia dicha disminución.

Bienes sobre los que se constituye el patrimonio familiar:

● Las casas de habitación; ● Los predios o parcelas cultivables; ● Los establecimientos industriales y comerciales, que sean objeto de explotación familiar

Características:

El patrimonio familiar descansa en estos fundamentos:

● Eminentemente económico, es decir, la protección de la propiedad contra los acreedores, y Article 355 states that in order to establish a family patrimony, the maximum amount must be one hundred thousand quetzales when it is constituted. The family wealth rests on these foundations:

● Eminently economic, that is, the protection of property against creditors, and ● Economic-moral, which implies the nonaffectation of certain assets.

Las características del patrimonio familiar son las siguientes:

a. Los bienes constituyentes del patrimonio son indivisibles; b. Son inalienables (no podrán enajenarse de modo alguno); c. Son inembargables; d. No puede constituirse en fraude de acreedores; e. Los miembros de la familia beneficiaria quedan obligados a habitar la casa o negocio establecido; y f. Están sujetos o expuestos a expropiación.

Elementos:

Los elementos que pueden formar parte del patrimonio familiar, son:

● Según Castán Tobeñas: "1 • Que el patrimonio por su composición constituye un conjunto unitario de derechos, y a veces también de obligaciones. 2• El patrimonio tiene una significación económica y pecuniaria. 3. La atribución a un titular como centro de sus relaciones únicas, que no excluye la posibilidad de que, en una misma persona, por razón de la variedad jerarquizada de los fines humanos, puedan concentrarse diversos núcleos 0 grupos patrimoniales'

● Según Juan Francisco Flores Juárez The characteristics of the family wealth are the following:

a. The assets constituting the patrimony are indivisible; b. They are inalienable (they cannot be alienated in any way); c. They are unattachable; d. It cannot be constituted in creditor fraud; e. The members of the beneficiary family are obliged to live in the house or established business; and f. They are subject to or exposed to expropriation.

Elements:

The elements that can be part of the family wealth, are:

● According to Castán Tobeñas: "1 • That the patrimony by its composition constitutes a unitary set of rights, and sometimes also of obligations. 2• Heritage has economic and pecuniary significance. 3. Attribution to a holder as the center of his [unique, which does not exclude the possibility that in the same person, by reason of the hierarchical variety of for human purposes, various nuclei or heritage groups may be concentrated'

● According to Juan Francisco Flores

Juárez, the elements are:

los elementos son: "El activo, constituido por los bienes y derechos, y el pasivo por las obligaciones y cargas; la diferencia entre ambos determina el haber patrimonial 0 bien el déficit patrimonial, según que el activo supere al pasivo 0 viceversa" .

Sujetos Obligados

El patrimonio es propiedad del que ostenta ese derecho, es por ello que anteriormente se analizó la propiedad y todo lo que de ella se deriva y de esa forma se tiene claro que al ser una persona propietaria de un bien puede disponer de ella como mejor le parezca, siempre observando lo que establece la ley. Entonces para que una persona pueda someter un bien a la institución del patrimonio familiar, debe primero tener un patrimonio y dentro de ese patrimonio debe haber un bien que sea de su propiedad y por ende poder disponer de él y seguir los procedimientos establecidos en la ley y constituir el patrimonio familiar.

En qué circunstancias puede terminar Obligated Subjects
